Abstract

ABSTRACTThis study aims to analyze the process of executing mortgages that do not belong to the debtor at PT. BANK RAKYAT INDONESIA (Persero) Tbk Bima Branch Office, as well as analyzing the legal protection for the owner of the mortgage object guaranteed by the debtor. This research method uses the normative-empirical research method. This study uses a statutory, conceptual, and sociological approach. In the execution of the Mortgage, either the object of the Mortgage belongs to the debtor or someone else, so that if there is a default by the debtor. Thus, the creditor (bank) can still execute the object of collateral guaranteed by the debtor following the applicable provisions. Second, there is a vague norm regarding legal protection for debtors, especially third parties in imposing Mortgage Rights in the UUHT and the Banking Law.Keywords: Default, Execution, Mortgage ABSTRAKPenelitian ini bertujuan untuk menganalisis proses pelaksanaan eksekusi terhadap hak tanggungan yang bukan milik debitur pada PT. BANK RAKYAT INDONESIA (Persero) Tbk Kantor Cabang Bima, serta menganalisis perlindungan hukum bagi pemilik objek hak tanggungan yang dijaminkan oleh debitur. Metode penelitian ini menggunakan metode penelitian Normatif-Empris. Penelitian ini menggunakan pendekatan perundang-undangan, ,pendekatan konseptual, dan sosiologis. Dalam pelaksanaan eksekusi Hak Tanggungan entah objek Hak Tanggungan tersebut milik debitur ataupun orang lain, sehingga jika terjadi wanprestasi oleh pihak debitur. Maka, pihak kreditur (bank) tetap dapat melakukan eksekusi atas objek jaminan yang dijaminkan oleh pihak debitur sesuai dengan ketentuan yang berlaku. Kedua adanya kekaburan norma tentang perlindungan hukum terhadap pihak debitur terlebih pihak ketiga dalam membeabnkan Hak Tanggungan di UUHT dan UU Perbankan.Kata Kunci: Wanprestasi, Pelaksanaan Eksekusi, Hak Tanggungan
