Abstract
The Purpose of The Research Is to Examine the Implementation of Article 22 of Law No. 5 of 1999, Related to The Tender Conspiracy Carried Out by Business Actors In The Procurement of Government Goods In West Nusa Tenggara and The Legal Consequences of The Existence of Tender Conspiracy In The Procurement of Government Goods. The Research Approach Used in This Research Is Empirical Juridical Research. Legislative Approach, Conceptual and Case Approach. In This Study, Primary and Secondary Data Sources Were Used. The Method of Analysis Is a Qualitative Description Method. The Results of The Study That the Government Procurement of Goods in West Nusa Tenggara is in Accordance with Article 22 of Law No. 5 Of 1999 And Has Applied the Principles of Business Competition, Namely Efficient, Effective, Open and Competitive, Transparent, Fair/Non-Discriminatory, And Accountable. The Juridical Consequences of The Tender Conspiracy in The Procurement of Government Goods Will Be Subject to Sanctions in The Form of Cancellation of Bids, Disbursement of Bid Guarantees And Deposited In The State Treasury, As Well As The Proposed Imposition of a Black List on The Budget User Proxy.
