Abstract

This research analyzes juridically-normatively the authority of Acting Regional Heads in making strategic policies, especially in the context of the transition to simultaneous national elections. The appointment of an Acting Regional Head poses a fundamental dilemma between the demands of bureaucratic effectiveness and the principle of democratic legitimacy, because the Acting Regional Head does not have a political mandate from the people. Using a statutory and conceptual approach, this study aims to identify the limits of the authority of the Acting Regional Head and the legal implications of the strategic policy of the Acting Regional Head exceeding the authority. The results show that the authority of the Acting Regional Head is a mandate from the central government, not an attribution that is permanent or directly elected. This limits the authority of the Acting Regional Head in making strategic policies.
