Abstract
Current technology has developed, especially the use of social media algorithms. The increasing use of social media algorithms by social media platforms risks increasing violations of the data privacy of social users. Law Number 27 of 2022 concerning Personal Data Protection and international instruments such as GDPR can protect the data privacy rights of social media users in the data processing by digital platform algorithms, and assess the administrative, civil, and criminal law enforcement mechanisms for social media users in the event of misuse of personal data. This research is a normative legal research with a statute approach, conceptual approach, international treaty approach, and case study approach. The result of the study showed that although the PDP Law has adopted the principles of GDPR, its implementation is not running well by lack user awareness and lack of supervision; There is no obligation for transparency or algorithm audits so the potential for bias remains high; and repressive legal efforts against platform violators are still rarely implemented. There needs to be harmonization of national laws with international law, the establishment of independent institutions, and explicit regulations regarding social media algorithms.
